Path Cleared for Municipal Elections in Jharkhand, High Court Dismisses State Government’s Appeal

The path for municipal elections in Jharkhand is now clear. A division bench of the Jharkhand High Court, presided over by Acting Chief Justice Sujit Narayan Prasad, has dismissed the state government’s appeal.

 

Providing information on the matter, Jharkhand High Court advocate Dheeraj Kumar stated that the division bench upheld the earlier order of the single bench. It is noteworthy that after hearing a public interest litigation, the single bench had ordered the issuance of a notification for municipal elections within three weeks, by January 4, 2024.

The state government had filed an appeal before the division bench, arguing that the State Backward Commission still needs to assess the OBC population. Once the commission’s report is received, OBC reservation at the ward level will be determined based on the data, and hence additional time was required to conduct the elections.

However, the division bench dismissed the government’s appeal, clearing the way for the municipal elections to be held on time in the state.
